Definitions

"Account" means, any account provided by Pure Poker that you create to access certain Services.

"Conflict" means, any controversy related to this agreement, including without limitation claims arising out of or relating to any aspect of the relationship between you and Pure Poker, claims that arose before this agreement, and claims that may arise after the termination of this agreement; however, this does not include claims related to or arising from the enforcement or protection of Intellectual Property Rights, and is subject to any applicable statutory consumer rights laws in your local jurisdiction.

"Pure Poker" means, Pure Poker Inc. d/b/a Pure Poker Online located at 838 Walker Road, Suite 21-2, in the city of Dover, County of Kent, Zip Code 19904. References to "Us," "We," or "Our" means Pure Poker, including any and all subsidiaries parent companies, joint ventures, and other corporate entities under common ownership and/or any of their agents, consultants, employees, officers, and directors. Pure Poker does not include Pure Poker Affiliates or third parties (analytics or ad tech companies, or similar organizations).

"Pure Poker Affiliate" (or "Pure Poker Affiliates") means Pure Poker's third-party content providers, distributors, licensees, or licensors.

"Intellectual Property Rights" means, any and all right, title, and interest of every kind whatsoever, whether now known or unknown, in and to patents, trade secret rights, copyrights, trademarks, service marks, trade dress and similar rights of any type under the laws of any governmental authority, including, without limitation, all applications and registrations relating to the foregoing.

"Notice" means, a delivered writing by e-mail, courier, or by Federal Express delivery to the other party at their respective address, and will be effective upon receipt.

"Privacy Policy" means, Pure Poker policy regarding privacy, which also governs your use of the Services and is incorporated herein by reference. The current version is available on our website.

"Service" (or "Services") means, any website, device, platform, content, and other related products and services provided by Pure Poker and Pure Poker Affiliates, including without limitation any titles, computer code, themes, objects, catch phrases, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, documentation, chat transcripts, profile information, recordings of games played using a Pure Poker game client, and Pure Poker game clients and server software.

"Terms of Service" (or "Terms") means, the terms and conditions in this agreement.

"User Content" means, any and all data that you upload, transmit, or create through the Services, including without limitation character skins, buildings, forum posts, Account personas, profile information, software, sound, images, videos, precise and imprecise location data, EXIF data, timestamps, metadata, and any other content contributed by users to the Services.

Real-Money Gameplay and Risk of Loss

By participating in real-money poker games, you acknowledge that you may lose some or all of the funds you have deposited. All gameplay outcomes are final. Pure Poker is not responsible for losses incurred during normal gameplay, and no refunds will be issued for funds lost in games.

User Conduct and Community Standards

By creating an account or using Pure Poker, you agree to abide by our community standards and all applicable laws and regulations. We are committed to maintaining a safe, respectful, and inclusive environment for all users. Accordingly, there is zero tolerance for objectionable content or abusive behavior on the platform.

You agree not to post, share, or otherwise engage in any content or behavior that:

• Is unlawful, defamatory, harassing, threatening, hateful, discriminatory, or otherwise offensive or harmful;

• Contains nudity, pornography, or sexually explicit material;

• Promotes violence, self-harm, illegal activity, or gambling outside of the rules and jurisdictions permitted by Pure Poker;

• Infringes on the intellectual property or privacy rights of others;

• Impersonates any person or entity, or misrepresents your affiliation with another person or organization; or

• Interferes with or disrupts the security, integrity, or proper functioning of Pure Poker or its users.

Violation of these terms may result in immediate suspension or termination of your account, removal of any offending content, and potential notification to law enforcement where required by law. Pure Poker reserves the right to monitor, review, and remove any user content that violates these Terms or is deemed objectionable in our sole discretion.

By using Pure Poker, you acknowledge and agree that maintaining a respectful and safe environment is a shared responsibility, and that your continued use of the platform constitutes acceptance of these standards.

Third-Party Service Providers and Financial Data

Plaid Identity Verification: Pure Poker Inc. uses Plaid, Inc. (“Plaid”) to gather your data from financial institutions and comply with identify verification regulations. You agree to complete identity verification (KYC) and provide accurate personal information. You confirm that you are the authorized holder of any payment method used. Any attempt to use another person's payment method or identity is strictly prohibited and may result in account suspension. By using our Service, you grant Pure Poker Inc. and Plaid the right, power, and authority to act on your behalf to access and transmit your personal and financial information from the relevant financial institution. You agree to your personal and financial information being transferred, stored, and processed by Plaid in accordance with the Plaid Privacy Policy.

By linking your bank account or using any financial features powered by Plaid within the Pure Poker Inc. platform, you expressly acknowledge and agree to be bound by:

1. Plaid’s End User Services Agreement; and

2. Plaid’s Privacy Policy.

Pure Poker Inc. is not responsible for the products or services provided by Plaid. While we use Plaid to facilitate secure connections, any disputes regarding the data gathered by Plaid or Plaid’s internal security protocols must be resolved directly with Plaid as outlined in their respective legal agreements.

Aeropay Payments: Pure Poker Inc. has partnered with financial services software company Aeropay to offer you ACH payments. When you create a Pure Poker Inc. Account and connect a bank to complete ACH payments, you will be creating an Aeropay account. You authorize Pure Poker Inc. to share your identifying information with Aeropay to open and support your Pure Poker Inc. Account. You must comply also with Aeropay’s Terms of Service when creating or using your Pure Poker Inc. Account. The Aeropay Terms of Service may be modified from time to time, and the governing version is incorporated by reference into this Terms of Service. Any term not defined in this section but defined in the Aeropay Terms of Service assumes the meaning as defined in the Aeropay Terms of Service.

Apple App Store Supplemental Terms

The following terms and conditions apply to you only if you are using the Pure Poker mobile application (the “Licensed Application”) on an Apple iOS device. You acknowledge and agree that these terms are concluded between you and Pure Poker, Inc. only, and not with Apple, Inc. (“Apple”).

1. Acknowledgement: Pure Poker, Inc., and not Apple, is solely responsible for the Licensed Application and the content thereof. In the event of any conflict between these Terms of Service and the Apple Standard EULA, these terms shall govern.

2. Scope of License: The license granted to you for the Licensed Application is limited to a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

3. Maintenance and Support: Pure Poker, Inc. is solely responsible for providing any maintenance and support services with respect to the Licensed Application. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

4. Warranty: Pure Poker, Inc. is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application.

5. Product Claims: You acknowledge that Pure Poker, Inc., and not Apple, is responsible for addressing any claims of yours or any third party relating to the Licensed Application or your possession and/or use of that Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

6. Intellectual Property Rights: You acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of that Licensed Application infringes that third party’s intellectual property rights, Pure Poker, Inc., and not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

7. Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third Party Terms of Agreement: You must comply with applicable third-party terms of agreement when using the Licensed Application (e.g., you must not be in violation of your wireless data service agreement when using the App).

10. Third Party Beneficiary: You and Pure Poker, Inc. acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

Governing Law and Jurisdiction

These Terms and Conditions, your use of the App, and all services provided by PurePoker shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

By using this site, you irrevocably agree that the state and federal courts located in Delaware shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms or their subject matter.
